Section 106 Programmatic Agreement (PA)

The District Department of Transportation (DDOT) must comply with Section 106 of the National Historic Preservation Act (NHPA) of 1966 for actions that are federally owned buildings or facilities, use federal funding, or require a Federal permit, license, or approval.

Section 106 requires agencies to consider the effects of their actions upon historic resources listed or eligible for listing in the National Register of Historic Places when planning projects. DDOT, the Federal Highway Administration (FHWA), DC Division, and the District of Columbia State Historic Preservation Office (SHPO) have developed policies and procedures to facilitate the Section 106 review of transportation projects in the District. Along with the Advisory Council on Historic Preservation (ACHP), these agencies first developed a Programmatic Agreement in 2008.

The agencies have collaborated to develop a new Agreement to facilitate the Section 106 review of transportation projects in the District. The new agreement was executed on September 1, 2021, and has a duration of five years.
